These rules and terms govern the Framery campaign (hereinafter the “Campaign”), which is organized as a draw on the website frameryacoustics.com (the “Website”). By entering the Campaign, the individual wishing to participate in the Campaign agrees to be bound by these terms.
- Organizer of the Campaign
The Campaign is organized by Framery Oy, Patamäenkatu 7, 33900 Tampere, Finland, Business ID: 2352713-9 (“Framery” or the “Organizer”).
- Duration of the Campaign
The Campaign begins on June 27th 2022 and ends on October 31st 2022 11.59PM.
- Who can participate
Participants must be 18 years of age or older at the time they participate in the Campaign. Employees of Framery, its affiliates, partners or agents and members of their immediate families are not eligible to participate in the Campaign. Organizer reserves the right to verify any participant’s eligibility. No purchase is required in order to participate in the Campaign and a purchase will not increase chances of winning.
- How to participate
Participation in the Campaign happens on the Website. Participation in the Campaign can be carried out by making an entry on the Website by following the instructions set out thereon.
- Prize draw and informing the winners
Three (3) prize winner will be drawn randomly by Organizer on the following date: November 7th 2022. The draw will be conducted among all eligible entries.
The winners will be notified personally via contact information filled on the Campaign entry form (e.g. e-mail) right after prize has been drawn. The prize winner will be required to confirm acceptance of the prize within 10 days from the date of the contact. If a prize winner does not confirm the acceptance of the prize, or prize notification is returned as un-claimed or undeliverable, a redraw shall be conducted immediately and the new winner will be notified via e-mail.
Framery reserves the right to publish the Winner’s name and city of residence on Framery website and social media channels.
In connection with the Campaign, the Organizer will draw three (3) Framery One pods (worth 10 000 €) as a prize of the Campaign.
The Organizer will pay the taxes related to the prizes. There are no cash alternatives available, and the prizes can and will not be exchanged to cash or replaced to any other product. The prize will not be handed out for resale.
- Processing of personal data in connection with the Campaign
The Organizer is not liable for any indirect damages or damages that the Organizer could not reasonably have foreseen. The Organizer is not liable for damages caused by third parties or reasons not attributable to the Organizer (such as interruption of the Campaign or damages attributable to a failure in network connections/communications). The Organizer accepts no responsibility whatsoever for damage or loss resulting from late, misdirected or incomplete entries, and by taking part in the Campaign the participant warrants that all information submitted is true, current and complete at the time of submission. It is the participant’s sole responsibility to ensure that the participant’s (contact information) details are accurate. The prize winner shall relieve the Organizer and all the companies that participated in planning and implementing the Campaign from all responsibility relating to damage arising from entering into the Campaign or from redeeming and using the prizes.
Nothing in these Campaign terms and conditions limits, excludes or modifies or purpots to limit, exclude or modify the statutory consumer guarantees as provided under applicable mandatory consumer laws.
- Rights to the material submitted in the context of the Campaign
In case the participant submits any material to the Campaign, such as stories or photographs, the participant warrants and represents, by participating in the Campaign, that the participant has created the material the submitted to the Campaign (“Campaign Material”), and if the Campaign Material has been created by a third party, has received from said third party their consent to submit the Campaign Material to the Campaign in accordance with these terms and conditions. The participant warrants and represents that the Campaign Material does not infringe the law, is not in breach of good practice or the rights of third parties (including copyrights and other intellectual property rights and privacy of other persons), does not harm the good name or personal integrity of others, and does not divulge any trade secrets, as well as that the Campaign Material is not, in any other way or form, contrary to these terms. The participant is responsible for, e.g., ensuring that any persons appearing in the Campaign Material has given their permission for the submission to the Campaign in accordance with these terms and conditions, and that no third parties’ trademarks are visible in the Campaign Material (e.g. a third party’s logo appearing in the picture).
Organizer may, at its discretion, use the texts or photographs published by the participants in connection with the Campaign or otherwise submitted to the Campaign by the participant, in Organizers’ communications and marketing channels globally without additional compensation to the participants.
Therefore, by entering the Campaign by submitting Campaign Material (i.e. text or image) via filling the Campaign entry form on the website, the participant gives Organizer, without separate compensation, a limited right to use the Campaign Material. This right of use gives Organizer the right to use the Campaign Material in Organizers’ marketing executions on social media channels and on Organizer’s websites.
If there is a reason to suspect a participant of fraud or some other act in breach of the terms and conditions, Organizer has the right to reject their participation.
Organizer will notify the participants through the Campaign marketing channels, if Organizer needs to make changes in the Campaign, its prizes, dates, availability or other factors that have an effect on the implementation of the Campaign. Organizer reserves the right to change the Campaign and the Campaign rules in a way that does not have a significant impact on participants.
The Campaign is not sponsored, recommended, endorsed or administrated by, or associated with, Facebook, Instagram, LinkedIn or any other social network. However, in addition to these campaign rules, the participants also commit to following the terms and conditions and rules of said social media services. The participants relieve Instagram, Facebook and LinkedIn of any and all responsibilities and claims in connection with, and pertaining to the Campaign.
